The merger of the secretariats of the Federal Revenue and Social Security Revenue, known as Super-Receita, was approved this Wednesday (6/12) by the Senate's Constitution, Justice and Citizenship Committee. According to the rapporteur of the Chamber's Bill (PLC 20/06), Senator Aloizio Mercadante (PT-SP), the objective is to reorganize the Union's tax administration. The rapporteur also considered constitutional the rule that determines the transfer, to the Union, of assets currently belonging to the National Social Security Institute (INSS), claiming that it is a common measure when administrative transfers occur between direct and indirect administration.
Mercadante also argued that the transformation and unification of the positions of tax auditor at the Federal Revenue and tax auditor at Social Security, into the positions of tax auditor at the Federal Revenue of Brazil, is also not unconstitutional. For the entity, uniting the bodies into a single fund would allow the government to use Social Security resources for other purposes, such as paying public debt, for example, a factor that, according to Unafisco, violates constitutionality. The National Union of Federal Revenue Technicians (Sindireceita) is in favor of the creation of Super-Receita. For the entity's president, Paulo Antenor Oliveira, the matter represents progress in tax legislation. Now, the text goes to the Plenary for voting.in an ADI, on the unconstitutionality of the repetition of overpayments when the triggering event occurs at a lower price than assumed.
